These Terms and Conditions govern your access to and use of the Properly website, including any articles, property information, calculators, reports, guides, videos, downloadable resources and other content made available through it.

This website is operated by Slice Group AU Pty Ltd T/A "Properly", "Properly Investing" (ABN 76 685 062 926, ACN 685 062 926) (“Properly”, "Properly Investing", “we”, “us” or “our”).

By accessing or using this website, you agree to these terms. If you do not agree with them, you should not use the website.

2. General information only

The content on this website is provided for general information and educational purposes only.

It does not constitute personal financial, investment, taxation, legal, accounting, credit or property advice and does not take into account your individual objectives, financial circumstances, borrowing capacity or needs.

Before making a property or investment decision, you should consider your circumstances and obtain independent advice from appropriately qualified professionals.

3. Buyer’s agency services

Information on this website does not constitute an offer to act as your buyer’s agent and does not create an agency, advisory, fiduciary or client relationship between you and Properly.

Buyer’s agency services will only be provided after we have accepted your engagement and the parties have entered into a separate written agency agreement.

That agency agreement will set out the scope of our services, fees, responsibilities, authority, termination rights and other terms applying to the engagement. If there is any inconsistency between these website terms and a signed agency agreement, the signed agency agreement will prevail in relation to the services covered by it.

4. Property and investment information

Property prices, rental estimates, yields, growth rates, vacancy rates, borrowing costs, development costs, cash-flow figures and other financial calculations displayed on this website are estimates or examples only.

They may be based on assumptions, historical information, publicly available data or information supplied by third parties. Actual results may differ because of factors including:

13. Australian Consumer Law

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Competition and Consumer Act 2010 (Cth), the Australian Consumer Law or any other applicable legislation.

Where our liability can lawfully be limited, our liability will be limited to the extent permitted by law.

Australian Consumer Law guarantees applying to services cannot be excluded by contractual wording.

Subject to clause 13 and to the maximum extent permitted by law, Properly and its directors, employees, contractors and representatives are not liable for loss arising from:

  • an investment or property decision made without a formal engagement;
  • inaccurate, incomplete or outdated third-party information;
  • changes in property markets, interest rates or lending policies;
  • the performance or availability of a property;
  • interruptions, errors or security issues affecting the website;
  • use of a third-party website, product or service; or
  • circumstances outside our reasonable control.

To the extent permitted by law, we are not liable for indirect, consequential or special loss, loss of opportunity, loss of profit, loss of rent or loss of anticipated savings arising from your use of the website.

15. Indemnity

To the extent permitted by law, you agree to indemnify Properly against loss, damage, cost or liability reasonably incurred as a direct result of:

  • your unlawful use of the website;
  • your material breach of these terms;
  • information you submit that infringes another person’s rights; or
  • your misuse or unauthorised distribution of our intellectual property.

This indemnity does not apply to the extent that the loss was caused or contributed to by Properly’s negligence, unlawful conduct or breach of these terms.

We collect and handle personal information in accordance with our Privacy Policy.

By submitting an enquiry, booking a consultation or requesting a resource, you acknowledge that we may use your information to respond to your request and administer our relationship with you.

Marketing communications will be sent only where permitted by law, and you may unsubscribe at any time.

17. Changes to these terms

We may update these terms from time to time to reflect changes to our website, services or legal obligations.

The current version will be published on this page with an updated revision date. Changes will apply from the date they are published and will not retrospectively alter any signed agency agreement.

18. Severability

If any provision of these terms is invalid, unlawful or unenforceable, that provision will be read down to the extent necessary or removed.

The remaining provisions will continue to apply.

19. Governing law

These terms are governed by the laws of New South Wales, Australia.

You and Properly submit to the non-exclusive jurisdiction of the courts of New South Wales and any courts entitled to hear appeals from them.
